Pool Code Compliance Is Not Optional in New Jersey
If you have a pool in New Jersey — in-ground, above-ground, or hot tub — state code requires a fence that meets specific height, gate, and access requirements. Inspectors check for compliance before pool use, and non-compliant fencing means no certificate of approval, no insurance coverage in many cases, and serious liability if someone is injured.

What NJ Pool Code Actually Requires
NJ pool code is based on the 2018 International Swimming Pool and Spa Code (ISPSC), codified into New Jersey's Building Subcode. The code sets specific standards for residential pool barriers. Here's what your fence must include:
Minimum 4-Foot Height
Fence must be at least 48 inches tall measured from the ground on the outside of the fence. Most NJ municipalities require 4 feet, some require 5 feet — check your local ordinance.
No Footholds or Handholds
The fence cannot have horizontal supports a child could use to climb. This rules out most chain link and certain wood designs.
Maximum Opening Size
Vertical openings between pickets cannot exceed 1¾ inches when horizontal rails are less than 45 inches apart. If horizontal rails are 45 inches apart or more, vertical openings can be up to 4 inches. The bottom gap cannot exceed 4 inches. This is why standard chain link rarely meets pool code without modification.
Climb-Resistant Design
No horizontal rails, decorative elements, or footholds within 45 inches of the ground that could allow children to climb over. This eliminates many traditional fence styles for pool use.
Self-Closing Gates
All pool gates must close and latch automatically without manual assistance. Gates must swing outward away from the pool. Manual latches fail inspection every time.
Self-Latching Gates
Gate latches must engage and lock automatically, and be positioned at least 48 inches above the ground. If the latch is positioned below 54 inches, it must be installed on the pool side of the gate, at least 3 inches below the top of the gate, with no openings larger than ½ inch within 18 inches of the latch.
Gate Swing Direction
Pool gates must swing OUTWARD away from the pool — never inward. This prevents children from pushing gates open while leaning on them.
